Terms And Conditions

These Terms of Service (“Terms”) govern the marketing, facilitation, and related services (“Services”) provided by ADYA REALTECH LLP, an Agent incorporated under the laws of India, having its registered office at [Address] (hereinafter referred to as an Agent/Channel Partner).

By accessing or using our Services, you (“User,” “Client,” or “Customer”) acknowledge that you have read, understood, and agreed to these Terms.

  1. Scope of Services

1.1 We engage in marketing and facilitation of sales of real estate projects not limited to Residential Apartments, Commercial Spaces, Land & Plotted Developments, Mixed Use Projects only but anything which comes under the definition of Real Estate, being developed and sold by Real Estate developers/Promoters registered under the respective State Real Estate Regulatory Authority.
1.2 For projects located outside India, We act solely as a marketing facilitator and do not provide legal or financial assurance regarding compliance with Indian or foreign laws.
1.3 We do not own, construct, or develop any project unless expressly disclosed.

  1. Compliance with RERA

2.1 For Indian projects:

  • Only projects registered under the respective State Real Estate Regulatory Authority are marketed by us.
  • Our respective State RERA Registration Number and other disclosures will be provided in all marketing communications.
  • Users can verify details on the official  RERA website of the concerned state.

2.2 For international projects:

  • Indian RERA provisions do not apply.
  • Users are responsible for ensuring compliance with FEMA, RBI guidelines, taxation laws, and foreign property laws before making any purchase.

 

  1. Role of The Agent/Channel Partner & Limitation of Liability

3.1 We act as an intermediary/real estate agent registered with the relevant State

RERA Authority(ies), where applicable.
3.2  All representations regarding project approvals, Land Uses, timelines, pricing,

amenities, Project Visuals,Quality of Construction, Warranties/Guarantees,

Completion Dates are made by the Developer/Promoter and not by us.

3.3 We are not liable for any liability for delay of any type not in our direct control,

default, Quality issue, Fraudulent activity or misrepresentation by Developers,

Regulatory Changes or Currency Fluctuations.

3.4. We do not promote/guarantee any Return on Investment schemes.

3.5. We do not guarantee Appreciation of Projects.

3.6. Our liability is limited to the extent of fees (if any) received directly from the User.\

3.7. We are not liable on event a Developer declares himself or gets declared as Bankrupt.

  1. User Responsibilities

4.1 Users must conduct independent due diligence before booking or purchasing a property.
4.2 Users must ensure compliance with Indian and foreign laws when purchasing properties outside India.
4.3 Users agree not to hold us liable for investment decisions based on marketing or promotional material.

  1. Fees & Payments

5.1 We may receive commissions or service fees from Developers.
5.2 Any booking amounts, instalments, or property payments shall be made directly to the Developer’s designated bank account as per RERA requirements.
5.3 We do not collect or hold User funds for property purchase, except for service-related fees if separately agreed.

  1. Refund & Cancellation Policy

6.1 For Indian projects under RERA:

  • Users may cancel their booking as per the Agreement for Sale executed with the Developer.
  • Refunds (after permissible deductions, if any) shall be processed by the Developer in accordance with RERA provisions.
  • We are not responsible for refunds, but may facilitate communication with the Developer.

6.2 For international projects:

  • Refunds and cancellations shall be governed by the laws and policies of the concerned Developer/jurisdiction.
  • Users must verify these terms before booking.
  • We bear no responsibility for refund delays or denials by foreign Developers or any loss due to Currency fluctuations.
  1. Intellectual Property

All branding, Logo, promotional material, and marketing content created by We remain its exclusive intellectual property and may not be reused without consent, other than those provided by the Developer/Promoter.

  1. Privacy & Data Protection

Users consent to the use of his/her/theirs personal data for marketing and receive calls/promotional emailers/messages in any form, and this consent overrides its status of Do Not Disturb as per TRAI/appropriate authority of their Country of Residence.

 

  1. Web Browser Cookies

Our Site (adyaproperties.com) may use “cookies” to enhance User experience. User’s web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. User may choose to set their web browser to refuse cookies, or to alert the Users when cookies are being sent. If they do so, note that some parts of the Site may not function properly. This is a standard operating procedure that is used across the internet.

How We Use Collected Information
Adya Realtech LLP alias Adya Properties may collect and use User’s personal information for the following purposes:

  • To improve customer service: Information provided by Users helps us respond to the customer service requests and support needs, more efficiently.
  • To personalize User experience: We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site.
  • To improve our Site: We may use feedback provided by the User/s to improve our products and services.
  • To run a promotion, contest, survey or other Site feature: We may use information to send Users information they agreed to receive about topics of interest to them.
  • To send periodic emails: We may use the email address to respond to the inquiries, questions, and/or other requests of User’s. If User’s decide to opt to be part of our mailing list, then the User’s will receive emails about company news, updates, related product or service information, etc. If at any time the User’s would like to unsubscribe from receiving future emails, they may do so by contacting us via our website.

How We Protect User’s Information

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of User’s personal information and data stored on our Site. As with data security, there are limits to its effectiveness and we indemnify ourselves in the event of an attack that is difficult to defend against. We also will do our best to retrieve any data that is lost as per available resources.

Sharing Personal Information of Users

We do not sell, trade, or rent User’s personal identification information to third parties.

  1. Dispute Resolution & Governing Law

10.1 For Indian projects: Disputes shall be governed by the RERA Act and referred to the concerned State RERA Authority or Adjudicating Officer.
10.2 For international projects: Disputes shall be governed by Indian law, and subject to the jurisdiction of courts at [Insert City, e.g., Mumbai, India], unless otherwise agreed with the Developer.
10.3 Parties shall first attempt amicable resolution before legal action.

  1. Amendments

We reserve the right to amend these Terms. Continued use of Services constitutes acceptance of changes.
